AGREEMENT TO TERMS AND CONDITIONS - (You accept the following when booking with us)
Dick Jensen & Alan McKay Tours acts as a sales agent for any airline. hotel. car-rental company, tour operator, cruise line. or other service provider named in your itinerary ('Suppliers'). Dick Jensen & Alan McKay Tours is not responsible for acts or omissions of the Suppliers or other parties not under Dick Jensen & Alan McKay Tours control (including personal injury or property damage). their failure to provide services or adhere to their own schedules. or their cessation of service or bankruptcy. You hereby release Dick Jensen & Alan McKay Tours from all claims arising out of any problem covered in this paragraph.
Dick Jensen & Alan McKay Tours assumes no responsibility for and shall not be liable for any refund, personal injury, property damage. or other loss, accident, delay. inconvenience, or irregularity which may be caused by: ( I) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment. or instrumentality owned, operated. or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omission on the part of any other party not under Dick Jensen & Alan McKay Tours control; or (4) acts of terrorism, natural disaster, weather. strike, labor trouble. riot, civil unrest. act of government authority. acts of God or any other contingency not under the reasonable control of Dick Jensen & Alan McKay Tours. You hereby release Dick Jensen & Alan McKay Tours from all claims arising out of any problem covered in this paragraph.You acknowledge that all payments to Dick Jensen & Alan McKay Tours are non-refundable.
You authorize Dick Jensen & Alan McKay Tours to provide your credit card information to suppliers to make payment for their services on your behalf. (only applies for airline upgrades - we do not store nor have access to your credit card information for online orders).
If Dick Jensen & Alan McKay Tours processes your credit card as payment, you agree to the following: Dick Jensen & Alan McKay Tours services consist of facilitating the sale and paying the Suppliers, and once Dick Jensen & Alan McKay Tours provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operation. your only recourse will be against the Supplier.
You acknowledge and understand and agree that: (1) airlines, cruise lines. tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions. and that you may be bound by those contracts regardless of whether you receive notice of their terms; (2) Airline schedule changes. mechanical or weather delays may affect flight times. Your connecting flights and/or transportation to and from the start and end point, whether issued by Dick Jensen & Alan McKay Tours or on your own arrangement. may be affected. Dick Jensen & Alan McKay Tours is not responsible for missed connections, delays. and/or cancelations. Once your first flight has commenced the air carrier controls your reservation. Any flight delays, missed connections, or cancelations must be re-scheduled by the responsible airline. By signing below, you consent to those terms and conditions.
Dick Jensen & Alan McKay Tours has no special knowledge regarding the financial condition of the Suppliers. unsafe conditions, health hazards, weather hazards, climate extremes, or suitability of booked services for any person. For information concerning possible dangers at destinations, Dick Jensen & Alan McKay Tours recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information Dick Jensen & Alan McKay Tours recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination or other entry requirements of your destination(s), and all conditions regarding health, safety. security. political stability. and labor or civil unrest at such destination(s). You hereby release Dick Jensen & Alan McKay Tours from all claims arising out of any problem covered in this paragraph. You agree that the courts in Davis County. State of Utah in the United States will be the exclusive jurisdiction for all claims brought by you or Dick Jensen & Alan McKay Tours. and you hereby submit to the personal jurisdiction of those courts.
You understand that the Transportation Security Administration (TSA) requires you to carry a government issued identification card in order to board a flight. You further acknowledge that beginning on October I, 2021, you must present a driver's license or other form of identification that complies
with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information). You have been advised that the name. date of birth and gender that appears on the ID card must exactly match the same such data that is listed on your airline ticket(s) and in booking record(s). You acknowledge that failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint.
You acknowledge and agree that any form of physical or verbal abuse including racism or derogatory comments regarding sexual orientation directed towards fellow group members, the tour host, or any individuals encountered during the tour is strictly prohibited. In the event of such misconduct as determined by our tour host or acting tour host, you understand that you will be required to leave the tour immediately. Additionally, you shall assume full responsibility for arranging your own airfare home and covering all associated expenses. Furthermore, if you violate any government regulations or rules set forth by our tour host and/or vendors, you will similarly be asked to leave the tour and be held accountable for arranging your return airfare and all related costs.

You acknowledge that photographs taken of you during the tour may be utilized for promotional purposes. By agreeing to these terms, you willingly waive any rights you may have to these photographs.
You understand and agree that it is essential for you to have the physical capability to walk throughout the tour. In the event that the tour host determines significant difficulties with your mobility, you may be requested to stay on the bus, stay at your hotel, and/or depart from the group. In such circumstances, you shall be responsible for arranging your own transportation and covering all expenses associated with your return home.
For travel to a foreign country, a government issued, non-expired U.S. passport book (with at least four blank visa pages) is required, regardless of age, for the destinations to which you are traveling. The name on your reservation must match exactly the name on your passport. Look at the expiration date on your passport. Please make sure your passport is valid for at least 6 months after travel is completed. (Some countries require one year or longer.) Children under the age of 18 traveling with only one parent or someone who is not a parent or legal guardian should travel with a notarized letter of consent. U.S. citizens may be denied entry to a country if they have ever been charged or convicted of a serious crime, including a DUI. Disability accommodations vary widely by country and supplier. It is your responsibility to disclose any disability that may impact travel and to provide the correct documentation as described. Failure to do so may result in denied boarding or entry. We are unable to refund unused flights.

You agree to review your travel documents for accuracy upon receipt and understand that you may contact Dick Jensen & Alan McKay Tours if you have any questions. You understand that discounted fares typically involve restrictions and that changing any aspect of your travel arrangements may result in the payment of additional money.
Payment constitutes acceptance of above stated terms and conditions in behalf of yourself and all participants traveling in your party.
